Guidance: realtor groups say keep client details out of free AI tools

On October 14, 2026, the Huntsville Area Association of Realtors shared a simple rule for agents: give an AI tool only the minimum it needs to do the job. A legal Q&A from Arizona REALTORS goes further and says that entering detailed client information into ChatGPT or other free AI platforms may breach a broker's duty of confidentiality and should be avoided.

Why it matters

This is guidance, not an incident. In the Arizona example, a buyer's email to their broker included their budget, their new job and their child's medical needs. The association notes that what goes into free AI platforms is typically stored, may be reviewed by human moderators, and could be exposed through unauthorized access or a data breach.

What to do

  • Before you paste, take out client names, phone numbers, emails, financial details and ID documents.
  • Keep full contracts, disclosures, inspection reports, offer details and lockbox or alarm codes out of AI tools. Check attachments and screenshots too.
  • Ask two questions first: does the AI really need this detail, and does my brokerage policy allow me to share it?
